Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the AKRUM website at akrum.io and any AKRUM software, APIs, AI agent products, SDKs, documentation, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you do not agree, do not access or use the Service.

2. Description of the Service

AKRUM provides cryptographic infrastructure built on a patented Cellular Automata entropy engine, including encrypted file engines, encrypted vault and document sharing, entropy benchmarking, and a suite of AI agent APIs that operate against encrypted workloads. Specific features available to you depend on the plan you subscribe to, the products you enable, and any custom agreement we have with you.

3. Accounts

To use most of the Service you must create an account. You agree to provide accurate and complete information, to keep that information current, and to maintain the security of your account credentials and API keys. You are responsible for all activity that occurs under your account. You must notify us promptly at security@akrum.io if you suspect any unauthorized access or use.

4. Acceptable Use

You agree not to, and not to permit anyone using your account or API keys to:

  • use the Service to violate any law, regulation, or third-party right;
  • use the Service to transmit, store, or process material that is unlawful, harmful, infringing, or sexually exploitative of minors;
  • attempt to gain unauthorized access to any part of the Service, any account, or any AKRUM system;
  • probe, scan, or test the vulnerability of the Service, or breach or circumvent any security or authentication measures, except as part of a coordinated disclosure under our security program;
  • interfere with or disrupt the Service or the servers and networks supporting it;
  • use the Service to send unsolicited bulk communications, spam, or malware;
  • reverse engineer, decompile, or otherwise attempt to derive the source code, underlying algorithms, or implementation details of the Service, including the AKRUM Cellular Automata entropy engine, except to the extent that this restriction is prohibited by applicable law;
  • use the Service to build a competing product that incorporates the AKRUM entropy engine or any other AKRUM proprietary cryptographic core; or
  • use the Service in any high-risk application where its failure could lead to death, personal injury, or severe environmental damage, unless we have specifically agreed in writing.

5. Intellectual Property

The Service, including the AKRUM Cellular Automata entropy engine, AI agent models, source code, documentation, design, trademarks, and any other AKRUM-owned materials, is and remains the exclusive property of AKRUM, Inc. and its licensors. The AKRUM entropy engine is protected under patent. Nothing in these Terms transfers any AKRUM intellectual property to you. You receive a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms and any applicable subscription plan.

6. Your Content

You retain ownership of the data you transmit to or process through the Service ("Customer Data"). You grant AKRUM only the limited license necessary to operate, secure, and deliver the Service to you. AKRUM does not read, scan, decrypt, or share encrypted Customer Data, and AKRUM does not use your Customer Data to train AI models for any party. You are solely responsible for the lawfulness of your Customer Data and for obtaining any consents or rights required to process it through the Service.

7. Subscriptions, Fees, and Refunds

Paid plans are billed in advance on a recurring basis (monthly or annual, as selected). Fees are non-refundable except where required by law or where we expressly agree otherwise. You authorize AKRUM and our payment processor to charge your designated payment method for all fees, taxes, and other charges associated with your account. We may change our fees with reasonable advance notice; changes take effect on your next renewal. Failure to pay may result in suspension or termination of access.

8. Free Trials and Sandboxes

We may make sandbox keys, free tiers, and trial features available. These are provided "as is" for evaluation purposes, may be modified or discontinued at any time, and may be subject to additional usage limits.

9. Disclaimers

Except as expressly stated in a separate written agreement, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. AKRUM does not warrant that the Service will be error-free, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components. You acknowledge that no cryptographic system is unconditionally secure and that you remain responsible for evaluating the suitability of the Service for your use case.

10. Limitation of Liability

To the maximum extent permitted by law, AKRUM and its affiliates, officers, employees, agents, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or in connection with the Service, whether in contract, tort (including negligence), or any other theory, even if we have been advised of the possibility of such damages. AKRUM's total cumulative liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid to AKRUM for the Service in the twelve months immediately preceding the event giving rise to liability, or (b) one hundred U.S. dollars (USD 100).

11. Indemnification

You agree to defend, indemnify, and hold harmless AKRUM and its affiliates, officers, employees, agents, suppliers, and licensors from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your Customer Data, your use of the Service in violation of these Terms, or your violation of any law or third-party right.

12. Termination

You may cancel your account at any time through your account settings. We may suspend or terminate your access to the Service if you violate these Terms, fail to pay fees when due, or use the Service in a way that creates risk for AKRUM or other customers. On termination, your right to access the Service ends immediately. Provisions of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.

13. Changes to These Terms

We may revise these Terms from time to time. We will post the revised Terms with an updated "Last updated" date and, for material changes, we will provide reasonable advance notice (for example, by email to account holders). Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Delaware, and you and AKRUM consent to the personal jurisdiction of those courts.
